ATLAS TRAVEL – TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern the relationship between you (the “Client”) and Tycheon Limited, a company incorporated in the Hong Kong Special Administrative Region (“Tycheon”, trading as “Atlas Travel”, “we”, “our”, or “us”), in connection with the provision of international travel planning and concierge services. By confirming a booking with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. GOVERNING LAW AND JURISDICTION

All services are governed exclusively by the laws of the Hong Kong SAR. Clients agree to submit to the exclusive jurisdiction of the courts of Hong Kong in respect of any dispute arising from or in connection with these Terms or any booking.

2. PRIVACY AND DATA USE

Atlas Travel complies with the Personal Data (Privacy) Ordinance (Cap. 486). Client data is collected and used solely for the purposes of service delivery and operational administration. Third-party agreements and supplier data remain confidential and are not subject to client access unless required under Hong Kong law.

3. BOOKINGS AND PAYMENTS

To confirm a booking, the client must execute the Tour Booking Contract, which includes these Terms, a detailed itinerary, and pricing summary. Upon receipt, a pro forma invoice will be issued.

A 50% deposit is payable to secure the reservation, with the balance due no later than 30 days prior to departure, unless otherwise specified. Failure to comply may result in cancellation without refund. Confirmation of booking occurs only upon receipt of both the signed contract and deposit.

Should any requested arrangement become unavailable, we will offer a suitable alternative. If materially different, the client may elect to accept or decline without penalty.

4. CURRENCY AND CONVERSION

All pricing is denominated in USD. Where payment is made in another currency, the equivalent amount is fixed using the HSBC Hong Kong Telegraphic Transfer (TT) Selling Rate on the date the signed contract is received. This rate is applied at the time of invoicing, and the corresponding amount becomes the final payable amount in that currency.

5. CHANGES AND CANCELLATIONS

Changes requested post-booking are subject to availability and may attract adjusted costs.

Cancellation Fees:

  • More than 90 days before departure: 50% of deposit
  • 60–90 days: 100% of deposit
  • 30–60 days: 50% of total package price
  • Fewer than 30 days: 100% of total package price

All cancellations must be submitted in writing and acknowledged by us. Refunds, where applicable, may take up to 90 days.

6. NO SHOWS

Failure to attend without notice constitutes a no-show. No credit, deferment, or refund will be provided.

7. POST-DEPARTURE AMENDMENTS

Once travel has commenced, changes are not entitled to refund. Any costs arising from mid-journey amendments are the sole responsibility of the client.

8. TRAVEL DOCUMENTS AND ENTRY

It is the client’s sole responsibility to ensure all travel documents (e.g., passport, visa, health clearances) are valid and compliant. No reimbursement shall be given for failure to meet entry requirements.

9. LIABILITY AND FORCE MAJEURE

Atlas Travel acts as a coordinator of services delivered by independent suppliers. We are not responsible for acts, omissions, or interruptions caused by third parties, nor for events beyond our control including but not limited to natural disasters, political unrest, or government actions.

We reserve the right to adjust services, schedules, or accommodations if necessary for operational, legal, or safety reasons. No compensation shall be due for such changes.

10. DOCUMENT SUPPORT AND CONFIDENTIALITY

We may, at our discretion, provide clients with documentation related to their confirmed arrangements, including booking summaries and payment records. Requests from external parties must be directed solely to Atlas Travel. Discretion will be exercised regarding any release of information, with redactions or high-level summaries issued where commercially appropriate.

11. SUPPLIER AGREEMENTS AND INTERMEDIARY ROLE

All supplier arrangements, including pricing, contracts, and correspondence, are commercially confidential. Atlas Travel is not an agent, partner, or guarantor of any third-party provider. Clients agree that Atlas Travel alone manages all supplier communication on their behalf and that no right of access to supplier contracts exists.

12. CLAIMS AND DISPUTE RESOLUTION

All concerns or service-related issues must be submitted in writing within 14 days of the journey’s conclusion. Any claim, legal or equitable, shall be brought solely against Atlas Travel under Hong Kong law. Clients expressly waive the right to pursue suppliers or affiliates of Atlas Travel directly.

13. CLIENT DISCRETION AND SERVICE ACCEPTANCE

Atlas Travel reserves the right to decline or discontinue services to any client at its sole discretion. Where support for external processes is sought, Atlas Travel will act reasonably and in good faith while upholding its contractual obligations and confidentiality undertakings.

14. WAIVERS AND ADDITIONAL TERMS

For select experiences, we may require additional waivers or acknowledgments. These shall form an integral part of the agreement once executed.
